EDA 4.0 - Terms & Conditions

Date of Last Revision: October 1, 2026

  1. General

These Terms & Conditions (“Terms”) govern the purchase and use of EDA 4.0, a software application for professional photographers and photography studios (“EDA 4.0”, the “App” or the “Software”). EDA 4.0 is operated by George Avgerinos, VAT No. 073291657, with business address at M. Hourmouzi 20, 54453 Thessaloniki, Greece (“EDA”, “we”, “us” or “our”). By purchasing a license for EDA 4.0 through our website, the customer (“Customer”, “you” or “your”) agrees to these Terms.

These Terms apply only to EDA 4.0 licenses purchased through the EDA website. They do not govern separate cooperation arrangements between EDA and professional photo laboratories, including EDA Online services. Such arrangements are governed by separate agreements signed between the relevant parties. By purchasing a license, you confirm that you have the legal capacity to enter into an agreement under applicable law.

  1. License to Use EDA 4.0

EDA 4.0 is licensed, not sold. You do not acquire ownership of the Software or any intellectual property rights in it. Subject to these Terms and payment of the applicable license fee, EDA grants you a limited, non-exclusive, non-transferable license to install and use EDA 4.0 during the purchased license period. One license permits installation and use of EDA 4.0 on up to two computers belonging to or used by the licensed photography studio or business. The two computers may be any combination of desktop computers, laptops or other supported computers.
Employees working for the same licensed photography studio or business may use EDA 4.0 on the licensed computers as part of that business. A license may not be shared with, transferred to, or used by a separate photography studio, photographer, company or other business that is not the licensed Customer. If a studio or business requires EDA 4.0 to be installed and used on more than two computers, it must contact EDA to obtain an additional license.

  1. Permitted Use

EDA 4.0 is intended for photographers and photography studios for use in their own photography business and album production. The Customer may use EDA 4.0 to design albums and related products for the Customer’s own photography clients as part of the Customer’s photography business. The Customer may not use EDA 4.0 as a standalone commercial design service for other photographers, photography studios, businesses or other third parties, including for the purpose of creating album layouts or designs on their behalf for payment or other commercial benefit. The Customer must not use EDA 4.0 for any unlawful purpose or in any manner that violates these Terms or applicable law.

  1. Intellectual Property

EDA 4.0, including its software code, interface, design, graphics, templates supplied with the Software, documentation, branding and other related materials, is owned by or licensed to EDA and is protected by applicable intellectual property laws.
All rights not expressly granted to the Customer under these Terms are reserved by EDA. The Customer may not copy, reproduce, modify, distribute, sell, rent, lease, sublicense, reverse engineer, decompile or otherwise attempt to derive the source code of EDA 4.0, except to the extent that such restriction is not permitted by applicable mandatory law.

  1. Purchase of a License

The Customer purchases an EDA 4.0 license through the EDA website by selecting the applicable license option and completing the payment process. The Customer is responsible for providing accurate and complete information required for the purchase and licensing of the Software. After payment has been received and confirmed, EDA provides the Customer with the installation file and a unique serial/license key required to activate the Software. Each serial/license key is uniquely associated with the Customer’s license and may not be transferred, sold, shared or used to activate the Software for another customer or separate business.

  1. License Activation

The Software requires activation using the serial/license key provided by EDA. The activation system may use information supplied by the Customer during the purchase and licensing process to associate the license with the Customer. If activation cannot be completed because the Customer has provided incorrect or incomplete information, the Customer should contact EDA for assistance.

  1. License Period, Expiration and Renewal

The license period depends on the subscription plan selected by the customer. Annual Prepaid Plan: The license is valid for 12 months from the date of purchase and automatically renews for successive 12-month periods unless cancelled by the customer. Monthly Payment Plan: The license is valid for one month and automatically renews for successive one-month periods unless cancelled by the customer.
4 Month Plan: The license is valid for four months and automatically renews for successive four-months periods unless cancelled by the customer. For all subscription plans, the renewal fee applicable to the selected plan will be charged automatically through PayPal at the beginning of each new subscription period.
The customer may cancel the automatic renewal through PayPal at any time before the next renewal date. Cancellation stops future renewals, but the license remains valid until the end of the subscription period that has already been paid for. If a recurring payment cannot be completed, the license may be suspended or expire after the applicable subscription period ends. EDA may contact the customer regarding the failed payment and any available options for continuing the license. After the license period expires, the software will no longer operate unless the subscription is renewed or a new valid license is obtained, as applicable.

  1. License and Account Security

The Customer is responsible for keeping the installation file, serial/license key and any account or purchase information reasonably secure. The Customer must not provide the serial/license key to another photographer, studio, company or third party for the purpose of enabling unauthorized use of the Software. If the Customer believes that a serial/license key has been disclosed or used without authorization, the Customer should notify EDA as soon as reasonably possible.

  1. Prices and Payment

Prices displayed on the EDA website are base prices and are exclusive of VAT unless otherwise expressly stated. The applicable VAT treatment is determined according to the Customer’s country and the tax rules applicable to the transaction. Where VAT is applicable, it will be added during the purchase process. Before completing payment, the Customer will be shown the final amount payable, including any applicable VAT, and may review the total price before confirming the purchase.
EDA reserves the right to change its prices from time to time. Any price change will not affect licenses that have already been purchased and paid for. Payment must be successfully completed before EDA is required to provide the installation file and serial/license key, unless otherwise agreed. Payments are currently processed through PayPal and may also be subject to PayPal’s applicable terms and conditions.

  1. Consumer Rights and Withdrawal

Nothing in these Terms is intended to exclude or limit any mandatory rights that the Customer may have under applicable consumer protection law. Where mandatory law provides a right of withdrawal, cancellation, refund or other consumer protection right in relation to the purchase or supply of digital software, that right will apply to the extent required by law. Any specific conditions relating to the supply and activation of digital content, including any requirements concerning the Customer’s express consent to immediate performance where applicable, will be handled in accordance with applicable law. The final wording of this section should be reviewed and confirmed by EDA’s legal adviser before publication.

  1. Software Updates and Changes

EDA may from time to time release updates, improvements, bug fixes or other changes to EDA 4.0. Updates may add, modify or remove features, provided that EDA is not required to maintain any particular feature permanently unless otherwise expressly agreed. Unless otherwise stated, updates provided for a valid license are intended to improve or maintain the Software and do not transfer ownership of the Software to the Customer.

  1. Technical Support

EDA will provide reasonable technical assistance regarding installation, activation and normal use of EDA 4.0 through the support channels made available by EDA. Support does not include providing professional photography, album design, computer repair, operating-system support or assistance with third-party software unless EDA expressly agrees otherwise.

  1. Customer Content and Responsibility

The Customer remains solely responsible for all photographs, images, designs and other content imported into or created using EDA 4.0. The Customer is responsible for ensuring that they have the necessary rights, permissions and licenses to use such content. EDA does not acquire ownership of the Customer’s photographs or other customer-created content merely because such content is processed using EDA 4.0.

  1. Software Availability and Warranties

EDA will make reasonable efforts to provide EDA 4.0 in working condition for customers holding a valid license. However, software may contain errors, interruptions or technical limitations, and EDA does not guarantee that the Software will be completely uninterrupted or error-free at all times. Except where mandatory law provides otherwise, EDA 4.0 is provided subject to the limitations and conditions stated in these Terms. The Customer is responsible for maintaining appropriate backups of photographs, album projects and other important data. EDA is not responsible for loss of Customer data resulting from the Customer’s failure to maintain appropriate backups.

  1. Termination and Suspension

EDA may suspend or terminate a license if the Customer materially breaches these Terms, including by sharing a license with another business, using the Software outside the permitted scope, or engaging in unauthorized commercial use. Where appropriate and permitted by applicable law, EDA may provide the Customer with an opportunity to correct a breach before termination. Termination or suspension does not limit any other rights or remedies available to EDA under applicable law. Upon termination or expiration of the license, the Customer must stop using EDA 4.0 unless and until a new valid license is obtained.

  1. Limitation of Liability

To the maximum extent permitted by applicable law, EDA will not be liable for indirect, incidental, special or consequential losses arising from the use of or inability to use EDA 4.0. EDA will not be responsible for losses caused by circumstances outside its reasonable control, misuse of the Software, unauthorized modifications, unsupported hardware or software environments, or failure by the Customer to maintain appropriate backups. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

  1. Force Majeure

EDA will not be considered in breach of these Terms where performance is prevented or materially delayed by circumstances beyond its reasonable control, including but not limited to natural disasters, serious technical failures, interruption of telecommunications or internet services, cyber incidents, war, governmental action, strikes or other events of force majeure.

  1. Privacy

EDA may process personal information provided by the Customer for purposes including processing purchases, issuing and managing licenses, providing support, preventing unauthorized use and complying with legal obligations. The processing of personal data is subject to EDA’s Privacy Policy, which forms part of the information provided to Customers on the website.

  1. Changes to These Terms

EDA may update these Terms from time to time to reflect changes to the Software, its services, legal requirements or business practices. The version of the Terms applicable to a purchase will be the version presented to the Customer at the time of that purchase, subject to any mandatory legal requirements. Updated Terms may apply to future purchases and renewals.

  1. Governing Law and Jurisdiction

These Terms are governed by the laws applicable in Greece, without prejudice to any mandatory consumer protection provisions that may apply to the Customer. Any disputes will be subject to the jurisdiction of the competent courts, subject to any mandatory rights the Customer may have under applicable law.
